This Privacy Policy explains how Mudilly (Pty) Ltd, trading as FirearmFlow (“FirearmFlow”, “we”, “us” or “our”) collects, uses and protects personal information when you use the FirearmFlow platform. FirearmFlow is a tool used by firearm consultants, competency trainers and gun shops to manage firearm licence applications.
Where a consultant, trainer or gun shop invites an applicant to FirearmFlow, that business is the responsible party for the applicant’s personal information and FirearmFlow acts as an operator (processor) on their behalf. For account holders (consultants and their staff), FirearmFlow is the responsible party.
We share information with trusted service providers who host and support the platform under confidentiality obligations. We do not sell your information. Application information is only made available to the consultant managing that application, and is submitted onward only at the direction of the applicant or their consultant. We may disclose information where required by law.
We use encryption and access controls to protect information, and store documents securely. No system is completely secure, and we work to protect information using reasonable technical and organisational measures.
We keep personal information only for as long as needed to provide the service and to meet legal, tax and regulatory requirements, after which it is deleted or de-identified.
Subject to applicable law, you may request access to, correction or deletion of your personal information, and may object to certain processing. Applicants should direct requests to their consultant in the first instance. To exercise your rights, contact our Information Officer below.

Because the Platform handles sensitive case data, cookies used within logged-in areas are limited to strictly necessary session, authentication, and security cookies, and functional cookies that improve usability. We do not use third-party advertising trackers within case-management areas of the Platform.

Our payment processor may set cookies when you make or manage a payment on the Platform. This provider acts as our operator and is contractually restricted from using data collected via cookies for its own purposes.

You are an "End User" if you are a client, or prospective client, of a firearm-licensing consultant ("Consultant") who uses the FirearmFlow platform (the "Platform") to manage your case, and you have been invited to access a client portal, e-sign a document, upload information, or otherwise interact with the Platform in connection with your Consultant's services.
These Terms cover your use of the FirearmFlow software only. They are not, and do not replace, the agreement between you and your Consultant for the consulting, advisory, or firearm-licensing services they provide to you. That relationship, including scope of work, fees, timelines, advice given, and outcomes, is governed entirely by your separate engagement with your Consultant, on whatever terms you and they have agreed. FirearmFlow is not a party to that engagement.
FirearmFlow is a software provider. We give your Consultant tools to manage your case file, store documents, communicate with you, and (where enabled) let you view status updates, upload documents, or sign forms electronically.
Your Consultant is responsible for deciding what personal information to collect from you and why, and is the "responsible party" for that information under POPIA. FirearmFlow processes your personal information on your Consultant's instructions, as an "operator," to provide the Platform. Our Privacy Policy explains this in more detail, including how to exercise your data subject rights (which you should generally do via your Consultant, since they control your case data).
Where your case involves special personal information (for example, information relevant to a criminal record check or a health-related declaration required for firearm competency), it is processed strictly for purposes connected to your licensing matter, under your Consultant's instruction and applicable law.
Where the Platform allows you to upload documents or sign forms electronically, you confirm that any document you upload or sign is true, accurate, and provided by you (or with proper authority if you are acting on someone else's behalf), and that you understand the legal effect of any document you electronically sign.
You must not use the Platform to submit false, fraudulent, or misleading information, attempt to interfere with the Platform's operation or security, or use the Platform for any unlawful purpose. Our Acceptable Use Policy applies to your use of the Platform as an End User where relevant.
The Platform is provided "as is." To the maximum extent permitted by law, FirearmFlow disclaims all warranties regarding the Platform's availability or fitness for a particular purpose, and is not liable for indirect, incidental, or consequential loss arising from your use of the Platform. Nothing in this section limits FirearmFlow's liability that cannot be excluded by law, nor does it limit any rights or remedies you may have against your Consultant under your separate engagement with them, which are unaffected by these Terms.
Your access to the Platform may be limited, suspended, or ended by your Consultant (e.g. at the end of your engagement) or by FirearmFlow for breach of these Terms or the Acceptable Use Policy. We may update these Terms from time to time; continued use of the Platform after changes take effect constitutes acceptance.
These Terms are governed by the laws of the Republic of South Africa, and the parties submit to the non-exclusive jurisdiction of the South African courts.

These Terms of Use ("Terms") govern access to and use of the FirearmFlow software platform (the "Platform") by firearm-licensing consultants and consulting businesses ("Consultant", "you"). By registering for or using the Platform, you agree to be bound by these Terms and by our Acceptable Use Policy, Privacy Policy, Cookie Policy, and POPIA & Data Protection Policy, which are incorporated by reference.
These Terms govern your use of the FirearmFlow software only. They do not govern, and are not, an agreement for consulting, advisory, licensing-application, or any other professional service that you provide to your own clients ("End Users"). Any such services are provided under a separate agreement between you and your End User, on terms you agree with them directly. FirearmFlow is not a party to that engagement and has no responsibility for the advice, service, or outcomes you provide.
The Platform is intended for use by firearm-licensing consultants, consulting businesses, and their authorised staff. By creating an account you confirm that you:
FirearmFlow provides tools that may include, depending on your plan: client/case management, document storage and templates, e-signature integrations, communication tools, scheduling, invoicing, and reporting, to help you manage your consulting practice. Available features may change over time, and we may add, modify, or discontinue features with reasonable notice where the change is material.
You acknowledge and agree that:
You agree to use the Platform in accordance with our Acceptable Use Policy. Without limiting that policy, you must not use the Platform to submit, store, or facilitate any application, document, or communication that you know to be false, fraudulent, or intended to circumvent applicable firearms-control laws or regulatory requirements.
The Platform, including its software, design, trademarks, and documentation, is owned by FirearmFlow or our licensors and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Platform for your internal business purposes during your subscription term. No other rights are granted.
The Platform may integrate with third-party services (e.g. payment processors, e-signature, SMS/email providers). Your use of such integrations may be subject to the third party's own terms. We are not responsible for the acts, omissions, or availability of third-party services.
The Platform is provided "as is" and "as available." To the maximum extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Platform will be uninterrupted, error-free, or that it will guarantee any particular regulatory or licensing outcome. FirearmFlow does not provide legal, regulatory, or firearm-competency advice, and nothing in the Platform constitutes such advice. See also our general Disclaimer.
To the maximum extent permitted by law:
You agree to indemnify and hold FirearmFlow harmless from claims, losses, and expenses (including reasonable legal fees) arising from: (a) Your Data or your use of the Platform; (b) your breach of these Terms, the Acceptable Use Policy, or applicable law; or (c) your engagement with, or services provided to, End Users.
Each party will keep the other's confidential information (including Your Data) confidential and use it only as permitted under these Terms, except where disclosure is required by law or regulatory authority.
These Terms are governed by the laws of the Republic of South Africa.
Before either party refers a dispute arising out of or relating to these Terms to litigation, the parties agree to first attempt to resolve the dispute in good faith through:
If the dispute remains unresolved after this process, either party may refer the matter to the South African courts, to whose non-exclusive jurisdiction the parties submit. Nothing in this clause prevents either party from seeking urgent interim relief from a court at any time.

We investigate reports in good faith and may take action including warnings, suspension, or termination, and may report suspected unlawful conduct (including suspected firearms-control offences) to the relevant authorities, including SAPS.

Firearm competency and licensing processes may require processing of special personal information under section 26 of POPIA (e.g. criminal record information, or health-related information relevant to fitness to possess a firearm). This is processed by Consultants:
FirearmFlow, as operator, applies the same security safeguards to this category of data as to other case data, with additional access restrictions where technically supported by the Platform.
Where personal information is transferred outside South Africa (e.g. to cloud infrastructure providers), we rely on the mechanisms permitted under section 72 of POPIA, such as the recipient being subject to a law, binding corporate rules, or contractual provisions that provide an adequate and comparable level of protection.
Data subjects (Consultants and End Users) may exercise rights under POPIA as described in our Privacy Policy. Requests relating to End User case data should be directed to the relevant Consultant in the first instance; FirearmFlow will support Consultants in responding to such requests within statutory timeframes.
If FirearmFlow becomes aware of a security compromise that has led, or may lead, to unauthorised access to or disclosure of personal information:

This manual is compiled in terms of section 51 of PAIA to facilitate requests for access to records held by Mudlilly (Pty) Ltd t/a Firearmflow.co.za ("FirearmFlow", "the Company"), and to describe how FirearmFlow, as a responsible party and operator under POPIA, processes personal information.
FirearmFlow operates a software platform used by firearm-licensing consultants ("Consultants") to manage client engagements and case files, and by their clients ("End Users") who interact with the platform in connection with those engagements.

Requests for access to records in section 7.2 should generally be directed to the relevant Consultant, who is the responsible party for that data; FirearmFlow will assist the Consultant in locating and providing records held on the Platform, consistent with our role as operator.

A requester who wishes to obtain access to a record of FirearmFlow must complete the prescribed request form (Form 2 under PAIA, or the applicable form prescribed by the Regulator from time to time) and submit it to the Information Officer using the contact details in section 2.

Fees: A request fee and, if access is granted, an access fee (calculated in accordance with the fees prescribed under PAIA) may be payable. Requests for a requester's own personal information do not attract a request fee.
Timeframe: FirearmFlow will respond within 30 days of receipt of a request, as required by PAIA (subject to any permitted extension).
Grounds for refusal: Access may be refused on grounds set out in Chapter 4, Part 3 of PAIA, including (among others) protection of privacy of third parties, commercial information, legally privileged information, and where disclosure would prejudice safety or law enforcement processes.
Where FirearmFlow elects to make additional categories of records automatically available in future, this manual will be updated accordingly.

FirearmFlow will review and update this manual on a regular basis, and at minimum whenever there is a material change to the categories of records held or processing activities described.
While FirearmFlow has taken reasonable care to compile an accurate description of records and processes, this manual may not be exhaustive, and does not itself create any right beyond those already provided for in PAIA and POPIA.

This Refund & Cancellation Policy applies to the purchase and use of credits and other paid functionality made available to registered consultants through the FirearmFlow platform (the "Platform"). It does not apply to fees that a FirearmFlow consultant charges their own clients or end users for consulting, advisory, application preparation or other professional services. Those fees are determined by the consultant under their separate agreement with their client.
FirearmFlow may amend this Policy from time to time. The latest version will be published on the FirearmFlow website with the applicable "Last updated" date. Changes will apply prospectively and will not remove or restrict rights that have already accrued to a customer under applicable law.
Consultants may register for a FirearmFlow account in accordance with the Platform's registration and verification requirements. Registration of a consultant account does not, by itself, create a paid subscription or recurring payment obligation. FirearmFlow may require verification, approval or additional information before granting a consultant access to particular Platform functionality.
Credits are purchased in advance.
FirearmFlow does not guarantee that a particular number of credits will be sufficient for any particular consultant, application or client matter where credit consumption depends on the consultant's use of the Platform.
Consultants are responsible for ensuring that they purchase the appropriate number of credits for their intended use.
A credit may be regarded as used once the consultant activates or accesses the relevant paid functionality for which that credit is required.
Once payment has been successfully processed, the purchased credits will be allocated to the consultant's FirearmFlow account.
Unless expressly stated otherwise at the time of purchase, FirearmFlow credits are not a recurring subscription.
If FirearmFlow introduces subscription-based products in the future, those products will be governed by the applicable subscription terms presented to the customer before the subscription is purchased.
No recurring payment will be taken merely because a consultant has purchased credits.
Purchasing credits does not automatically enrol a consultant into a monthly or annual subscription.
Changes to Pricing and Credits: FirearmFlow may change its credit prices, credit packages or the functionality associated with credits from time to time. Changes will apply to future purchases and will not retrospectively alter the price already paid for credits that have already been purchased, unless otherwise agreed or required by law.
VAT: As at the date this Policy was last updated, FirearmFlow is not a VAT-registered vendor. Accordingly, FirearmFlow does not currently charge VAT on its prices. If FirearmFlow becomes VAT-registered, applicable VAT will be charged in accordance with South African tax law and the pricing information presented at the time of purchase.
A consultant may stop using the Platform at any time.
Where a consultant has not yet used purchased credits, FirearmFlow may, at its discretion, consider a cancellation or refund request. Approval of such a request is not guaranteed unless the consultant has a statutory right to cancel or receive a refund.
Unused credits remain associated with the consultant's account, subject to any applicable expiry terms communicated at the time of purchase and the provisions of this Policy.
Stopping use of the Platform does not automatically cancel or reverse a completed credit purchase.
Nothing in this Policy limits or excludes any right that a customer may have under applicable South African law.
Where a statutory cooling-off, cancellation, refund or other consumer right applies to a transaction, FirearmFlow will honour that right.
For electronic transactions, certain consumers may have cancellation rights under the Electronic Communications and Transactions Act 25 of 2002. Those rights are subject to the Act and its exceptions and are not applicable to every transaction or every customer.
Where a transaction results from direct marketing and the Consumer Protection Act 68 of 2008 applies, the statutory cancellation provisions applicable to that transaction will apply, including the applicable five-business-day cooling-off period.

FirearmFlow may request additional information reasonably required to verify the transaction.
Where a refund is approved, it will ordinarily be processed to the original payment method within 10 business days, subject to the processing times of the relevant payment provider or financial institution.
Where applicable law prescribes a shorter refund period, the statutory period will apply.
Except where required by law, unused credits are generally non-refundable after purchase.
FirearmFlow may, however, approve a refund of unused credits at its discretion where there are exceptional circumstances.
Credits that have already been used to access or activate Platform functionality are generally non-refundable.
This does not affect any statutory right to a refund or remedy where the Platform or service was defective, not supplied as agreed, or otherwise gives rise to a remedy under applicable law.
If a consultant is charged:
the consultant should notify FirearmFlow as soon as reasonably possible.
FirearmFlow will investigate the transaction and, where an error is confirmed, refund the relevant overcharge to the original payment method.
If a payment is unsuccessful or a transaction is interrupted before credits are properly allocated, FirearmFlow will investigate the transaction.
A consultant will not be required to pay twice for the same successfully completed credit purchase.
If purchased functionality cannot reasonably be used because of a material technical fault attributable to FirearmFlow, the consultant should report the issue to FirearmFlow promptly. FirearmFlow will investigate and, where appropriate, restore access, restore incorrectly consumed credits, provide replacement credits or provide another reasonable remedy. Nothing in this section limits any remedy available to a customer under applicable law. Temporary interruptions caused by maintenance, third-party service providers, internet connectivity, security incidents, force majeure events or circumstances outside FirearmFlow's reasonable control will not automatically entitle a consultant to a refund.
FirearmFlow is a software platform and does not determine the fees that an independent consultant charges their own clients.
Any fee charged by a consultant to an end user for:
is a separate transaction between the consultant and the end user.
FirearmFlow is not responsible for refunds, cancellations or disputes concerning those fees.
Consultants are responsible for maintaining their own agreements, invoices, refund policies and disclosures with their clients.

FirearmFlow provides software tools (the "Platform") used by firearm-licensing consultants ("Consultants") to manage their client engagements and case files. FirearmFlow is not a firearms consultancy, law firm, or regulatory advisory business, and does not itself provide consulting, legal, or regulatory advice on firearm licensing, competency, ownership, or any related matter.
Nothing on this website or within the Platform, including templates, prompts, workflow tools, or general information content, constitutes legal, regulatory, safety, or professional advice from FirearmFlow. Any advice you receive is provided by your Consultant (if you are an End User) or is advice you provide to your own clients as a Consultant using our tools; FirearmFlow has no role in, and takes no responsibility for, that advice.
Use of the Platform does not guarantee any particular outcome in connection with a firearm licence, competency certificate, or any other regulatory application. Decisions on such applications are made solely by the relevant regulatory authority (e.g. the South African Police Service Central Firearms Register) in accordance with the Firearms Control Act 60 of 2000 and its regulations, and are entirely outside FirearmFlow's control.
Consultants using the Platform are independent businesses or individuals, not employees, agents, or representatives of FirearmFlow. FirearmFlow does not select, vet, endorse, or supervise Consultants' professional conduct, qualifications, or accreditation, and is not responsible for the quality, accuracy, or lawfulness of the services they provide. If you are an End User with a concern about the service you received, please raise it directly with your Consultant.
While we aim to keep the Platform and website accurate and up to date, we make no warranty as to the completeness, accuracy, or currency of any content, including regulatory information referenced on the Platform. Firearms-control law and related regulatory requirements and procedures can change; you should independently verify current legal requirements with the relevant authority or a qualified professional.
The Platform or website may link to, or integrate with, third-party websites or services. We do not control and are not responsible for the content, accuracy, or practices of third parties.
Your use of the website and Platform is at your own risk. To the maximum extent permitted by law, FirearmFlow disclaims liability for any loss or damage arising from reliance on content available on the website or Platform, save to the extent set out in our Terms of Use.
